Definitions:
- Website refers to The Lincolnshire Guide internet website. Also referred to as The Lincolnshire Guide.
- We/Us refers to the owners and operators of The Lincolnshire Guide website, situated at http://www.lincolnshireguide.co.uk as well as any duly authorised agents or representatives.
- You refers to the end user viewing the website.
- Clients refers to the individuals or businesses who have placed advertisements on The Lincolnshire Guide.
- Registered user is defined as an end-user who has chosen to register for an account on the website, but has not placed and had accepted an advertisement.
- Year is defined as a calendar year.
- Working days are defined as from Monday to Friday, excluding bank holidays and public holidays.
- Listing refers to an advertisement placed on the website by a client.
- The support team refers to agents supporting end-users, registered users and clients by email.

General Terms and Conditions
The Lincolnshire Guide accepts listings from tourism and leisure businesses across the county of Lincolnshire in the United Kingdom, and nearby locations. The listings are split into three main categories: accommodation, attractions and food & drink.
- Any number of listings can be requested by registered users and clients, however multiple listings for the same location are not accepted unless they cross the boundaries between the three main categories. For example, an attraction that also had a cafe or restaurant on-site would be able to take out a listing in both attractions and food & drink.
- Each listing is allocated a randomly-generated account number. This number must be quoted whenever contacting the support team regarding the account.
- Once a listing has been submitted, it is held for approval by the support team. The support team reserve the right to modify or remove pending listings in accordance with these terms and conditions.
- Free listings will become available as soon as they have been reviewed and accepted by the support team.
- Premium (paid for) listings must be paid for in full before the review and acceptance process can be completed. See payment section of terms and conditions for more information.
- Once a listing has been accepted and published, we reserve the right to modify listings at any time for any purpose laid down in these terms and conditions. You will be notified of any changes made to your listings. If you are not satisfied with the changes made you may appeal the changes within five working days by using the Contact Us link on any page of the website and noting the details of your appeal in your request.
- Clients have the ability to make changes to their account, both the overall registration account and listing accounts. Registration account changes occur immediately, however changes to listings are required to go through the same approval process as new listings. During this time the unedited version of the listing will remain on the website.
- All listings are made on a yearly basis. Listings not renewed after a year are automatically removed from the website. Listings can be re-activated after this time but we reserve the right to delete listings expired more than six months previously.
- Clients must ensure that their account details are kept up to date at all times. If they are not then important messages may be missed by the client regarding their account, or customer contact may go unnoticed.
- The website provides a means for end-users to find appropriate clients and contact them. The website is not a travel agent and does not purport to be so. Bookings are made directly with the client via email or telephone.
- We cannot be held responsible for the non-delivery of messages for any reason.
- We reserve the right to change the passwords of registered users and clients every six months, or as needs be, to ensure the security of the website. Passwords can be changed by the registered user/client at any time using the control panel. Password changes will be notified by an email to the registered email account.
- The terms and conditions are subject to change. However, we will notify registered users and clients of changes ten working days before the changes are due to come into action by means of email to their registered address. In the unlikely event that the terms and conditions should be required to be changed due to security issues we reserve the right to change terms and conditions immediately.
- You agree to use the website's services and facilities at your own risk.
- We specifically disclaim all warranties of merchantability and fitness for a particular purpose. In no event shall we be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold the website and its agents harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against the website, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns.
- Customer agrees to defend, indemnify and hold harmless the website and its' agents against liabilities arising out of:
- Any injury to person or property caused by any products sold or otherwise distributed in connection with a website listing;
- Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
- Copyright infringement and
- Any defective products or services sold to customer via a website listing
Spam Policy
We are committed to a zero-tolerance, anti-spamming policy. As part of this we prohibit clients from using information from end-users for purposes of email marketing, unless the end-user has specifically stated that this is acceptable to them (opt-in). Proven allegations of such unwanted email marketing may lead to forfeiture of listings.
Equally, we are committed to reducing the volume of inappropriate use of the contact scheme where end-users can send messages to clients. We have put measures in place to keep the volume to a minimum but clients should realise that spam marketing emails are an inevitable part of running a business online. We will endeavour to assist clients should they face issues with spam messages from the website, but we cannot be held responsible for it.
Content Policy
We want The Lincolnshire Guide to be a primary source of information for end-users visiting the County, as well as locals finding out more about their area. In order to do so it is essential that the information we hold is accurate and up to date.
- It is the responsibility of the client to ensure that their listing(s) accurately reflect the services they are offering. We cannot be held responsible for any mis-representation in advertisements.
- All the services on the website are provided for lawful purposes only.
- Transmission, storage, or presentation of any information, data or material in violation of any English Law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization.
- The subscriber agrees to indemnify and hold harmless the website and its' agents from any claims resulting from the use of the service which damages the subscriber or any other party.
- We remain the sole arbiter as to what constitutes acceptable content. Below is some guidance aimed to assist clients, it is not intended to be an exhaustive list of information.
- Listings must contain accurate information.
- The body text of premium listings must be your own work and should not be copied from other websites, irrelevant of ownership.
- Listings must not contain hyperlinks to other websites or other listings, other than to your given business website.
- Listings must not contain links to material that would not be considered 'family friendly'.
- Photographs on premium listings must be recent photographs and contain no identifiable images of people unless you have full written permission for their images to appear. Photographs must also be 'family friendly'.
- Listings should be written in a friendly and polite manner. Listings that refer to 'you' meaning the end-user and 'we' or 'us' meaning you, the client, work best.
- Try to ensure that the location chosen using the interactive map is as accurate as possible and that you include as much detail as possible in your listings, without going overboard. A successful listing is a well thought out listing.

Payment Terms and Conditions
- Payment must be received in full and cleared before premium listings can be made live.
- Once a payment has been received and the premium account listing has been created, no refunds are available.
Use of Vouchers/Special Offers
From time to time, The Lincolnshire Guide may decide to offer money-off vouchers for new or existing customers. In such cases, each individual business or organisation will be issued with a code that can be used to redeem discounts or free premium listings. Voucher use is at the discretion of the management team of The Lincolnshire Guide, and vouchers can be revoked at any time for any reason. Only one voucher may be used per listing, and once a voucher code is used it cannot be used again.
Special pricing arrangements may be available for large scale advertisers. Registered charities, local community groups and other similar organisations may also be able to obtain subsidised premium listings. Please contact us for more information.
Data Security/Backups
Full off-site backups are made weekly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for website restoration purposes only. It is the clients' responsibility to maintain a local copy of their listing content and information. If loss of data occurs due to an error of The Lincolnshire Guide, we will attempt to recover the data for no charge to the client. If data loss occurs due to negligence of client in securing their account or by an action of the client, we will attempt to recover the data from the most recent archive for a £20.00 fee per listing (maximum fee of £80.00).
